Trust/Estate & Litigation Attorney (contract) Job Opening in Atlanta, Georgia - Position Description:
The Trust/Estate aspect of this position requires an attorney to handle matters pertaining to the probate, inheritance, trusts and estates. Trusts and estates legal work can include aspects of family law, taxation law, business law, inheritance law and probate law, as well as issues of community property, joint ownership and charitable gifts.
A Trusts and Estate attorney provides advice to clients in estate planning from simple to complex planning structures, drafting of wills, a variety of trusts, funding and operation of trusts; advise on issues regarding wealth and property distribution to beneficiaries and family members.
The candidate will consult with and advise clients and fiduciaries in probate and trust administration, work with clients in connection with contested trust matters, review and request estate and trust accounting, complex reporting and valuation issues, assist clients in the establishment of special purpose trusts and charitable gifting.
The candidate will prepare various probate and trust administration documents, confirm and inventory the type, title and value of trust and estate assets, confirm calendar dates and relevant deadlines.
The candidate is required to follow instructions and the Firm's standard procedures provided by managing partner for all job tasks including the preparation of estate planning documents, drafting work, communicating with client with the goal to consult with clients, advise and resolve client issues independently.
The litigation aspect of this position requires the attorney to represent clients in the probate court and on occasion in trust litigation in superior courts, including meditations and settlements. Litigation attorneys are advocates who are familiar with court pleadings and court processes. Litigation attorneys are generally well-spoken advocates and are comfortable presenting cases in front of judges and juries.
The candidate should have prior experience with motion practice, discovery, dispute resolution and trial preparation.
This position is a contract to full-time opportunity.
Personal Skills:
Highly professional, team-oriented person who is able to work with minimal supervision and has a high level of attention to detail. The ability to effectively meet and interact with clients in an important aspect of this role. Representation of the law firm is required using poise, tact and professionalism while maintaining strict confidentiality.
Education:
Required: JD
Preferred in addition to JD: MBA
Experience:
Minimum of 5 years practice as an Estate Planning, Trust and Estate and/or Elder Law Attorney.
3-5 years experience in the areas of complex domestic estate planning, asset protection planning, trust and estate settlement.
Experience filing pleadings and general claims.
Must have a J.D. degree from a well-ranked ABA-approved law school and be an active member in good standing of the Georgia Bar.
Experience with taxation is a plus.
Computer Skills:
Excellent working knowledge of the latest MS Office Suite Programs, Google Documents, and internet research websites.
Preferred but not required:
Experience with Financial Planning and/or Life Insurance
