Recipient Rights Advisor Job Opening in Warren, Michigan - POSITION SUMMARY:
The Recipient Rights Advisor facilitates the prevention, investigation and monitoring of patients? rights.
QUALIFICATIONS:
Bachelor?s Degree in psychology or related field.
Minimum of two years experience in mental health field (preferred).
Experience and training in patient rights, working knowledge of the Michigan Mental Health Code and Administrative Rules (preferred).
DUTIES AND RESPONSIBILITIES: The duties set forth below describe the general nature and level of work being performed by the Recipients Rights Advisor. They are not intended to be construed as an exhaustive list of all responsibilities, duties, and skills required of the Recipient Rights Advisor since those duties include all tasks requested by the HR Director to meet the needs of the Center.
Investigation Duties:
The Recipient Rights Advisor shall be subordinate only to the HR Director and have unimpeded access to all of the following:
All programs and services operated or under contract with appropriate CMH programs.
All staff employed or under contract with appropriate CMH programs.
All evidence necessary to conduct a thorough investigation or to fulfill its monitoring functions.
The Recipient Rights Advisor shall be equipped and familiar with the following documents:

Receives complaints that rights were violated.
Investigates complaints which meet Office of Recipient Rights (ORR) standards.
Refers complainants with complaints which do not meet ORR standards to others for assistance.
Determines whether or not rights have been violated through investigation.
Refers violations of rights to the CEO for remedial action when action has not been taken. (If the CEO cannot or will not provide remedial action, refers case to the Board of Directors).
Informs dissatisfied complainants of the appeal process.
Monitoring Duties:
Maintains case files and other confidential information in a locked cabinet, accessible only to the Recipient Rights Advisor.
Maintains a record system for all reports, in accordance with QAPI dashboard, of apparent or suspected rights violations received, including a mechanism for logging in all complaints.
Monitors various reports to assure remedial action when apparent violations of rights are reported, including abuse, neglect, serious physical injury, expected death, discrimination and other apparent serious deprivation of rights, and apparent violations where remedial action would have serious impact on a class of recipients.
Reports monitored include: incident reports, seclusion and restraint reports, reports of the Department of Community Health (DCH) licensing unit, reports of the Auditor General, JCAHO reports, ICF/MR reports, death reports, etc.
Prepares monthly report on Recipient Rights issues for Risk Management/Safety Committee and Management Team. Also submits data reports, all recipient complaint forms and logs to appropriate CMH boards.
Notifies appropriate CMH boards of all unexpected deaths, serious abuse and serious neglect incidents.
Preventions Duties:
Attends initial training as Recipient Rights Advisor and updates training on regular basis and as needed due to changes in policy by attending state conference.
Visits facility units regularly, with the frequency necessary for protection of rights, ensures that recipients will be protected from rights violations while they are receiving services.
Ensures ORR education to each recipient, guardians or other legal representatives in a manner they can understand at the time services are initiated and periodically during the time services are provided, and that they have access to summaries of the rights guaranteed by Chapter 7 and 7A of the Mental Health Code.
Ensures that the name, telephone number and address of the Recipient Rights Advisor is conspicuously posted at all service sites.
Ensures ORR education to staff of the Center within 30 days of their employment.
Consults with staff of the Center on rights-related matter; ensures that complainants and any staff acting on behalf of a recipient will be protected from harassment or retaliation resulting from Recipient Rights activities, and that appropriate disciplinary action will be taken if there is evidence of harassment or retaliation by working with Human Resources.
Meets with advisory councils, etc.
Assists with drafting and reviewing Center rights-related policies and procedures, ensuring that policies are developed which are in compliance with Board expectation and the Mental Health Code.
Alerts the HR Director of the Center when practices may violate rights.
Responsible for announced or unannounced site visits.
Contacts the county ORR when there is a change in the Rights Office structure, as required by agency contract.
Performs other related duties in a willing manner as requested by the HR Director.
TRAINING:
Shall receive annual training
Within 3 months of hire shall attend Basic Skills I and II
Within 3 months of hire shall receive Developing Effective Rights Training (DERT)
